Terms of Service

1. Agreement

By accessing or using Substance AI (the "Service") operated at substance-ai.vercel.app, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract. The Service is invite-only and access may be granted or revoked at our discretion.

3. Your content

You retain ownership of all photos, videos, prompts, and other material you upload ("Your Content"). You grant Substance AI a limited licence to process Your Content solely to provide the Service to you, including running model inference, storing outputs, and, when you instruct us to, publishing outputs to social accounts you have connected.

You represent and warrant that:

  • you own or have all necessary rights and consents to upload Your Content;
  • every identifiable person in Your Content has given informed, written, and verifiable consent for that content to be uploaded, modified by AI, and (where you choose) published;
  • Your Content does not infringe any third-party rights or violate any law.

4. Acceptable use

You will not use the Service to:

  • generate or distribute sexual content involving minors, non-consensual intimate imagery, or content depicting real people without their explicit consent;
  • impersonate, defraud, harass, or defame any person;
  • generate election disinformation, deceptive political content, or content prohibited by Meta's Community Standards or Instagram's Community Guidelines;
  • circumvent rate limits, scrape the Service, or interfere with its operation;
  • resell or relicense the Service without our written permission.

We may suspend or terminate accounts that violate these rules without refund.

5. Connected social accounts

When you connect a Facebook or Instagram account, you authorise Substance AI to publish content and read account metadata on your behalf using Meta's APIs, strictly as described in our Privacy Policy. You remain solely responsible for the content you publish through the Service and for complying with Meta's Platform Terms, Community Standards, and Instagram Community Guidelines. You may disconnect a social account at any time, which revokes our access immediately.

6. Fees

Some features may require credits or a paid plan. Pricing, billing cycles, and refund policy are shown at point of purchase. Charges are non-refundable except where required by law.

7. Intellectual property

The Service, including code, models, branding, and design, is owned by Substance AI and licensed to you on a limited, non-exclusive, non-transferable basis for the duration of your subscription.

8. Disclaimers

The Service is provided "as is" without warranty of any kind. AI outputs may contain inaccuracies, artefacts, or unintended likenesses. You are responsible for reviewing outputs before publishing them.

9. Limitation of liability

To the maximum extent permitted by law, Substance AI's total liability for any claim arising from the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Indemnity

You agree to indemnify Substance AI against any claim, loss, or expense arising from Your Content, your use of the Service, or your breach of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or for any reason on reasonable notice. On termination, your right to use the Service ends and we may delete stored data after a reasonable wind-down period.

12. Governing law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes

We may update these Terms. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
